Terms of Use

By creating an account, subscribing to a plan or using any Imovely feature, you declare that you have read, understood and agree to these Terms of Use and to our Privacy Policy. If you do not agree with any condition, do not use the platform.

To use Imovely you must have legal capacity. If you use the platform on behalf of a real estate agency or company, you declare that you have the authority to accept these terms on its behalf.

Imovely is an artificial intelligence platform that helps real estate agents and agencies create the material for their listings: photo editing, videos, virtual tours and AI-generated descriptions.

The features use AI models to generate results from what you upload. Because of that, results may contain inaccuracies or variations. You are responsible for reviewing the material before publishing and for making sure it represents the property correctly and truthfully.

To access Imovely you create an account with true and up-to-date information. You are responsible for keeping your password confidential and for all activity carried out on your account.

Each account is individual. On agency plans, each agent has their own access. Let us know as soon as you notice any unauthorized use of your account.

We may suspend or terminate accounts that violate these terms, use the platform irregularly or put the security of the service at risk.

Imovely offers subscription plans and one-off credits. Prices, currencies and what each plan includes are available on the pricing page and at the time of purchase.

Subscriptions are charged on a recurring basis and renew automatically at the end of each period, until you cancel. Payment is processed by Stripe. By subscribing, you authorize the recurring charge on the chosen payment method.

You can cancel the renewal whenever you want, directly on the platform, and you keep access until the end of the period already paid for. Amounts, deadlines and refund conditions follow our Refund Policy.

Agency plans (Enterprise)

Enterprise contracts by a legal entity may have specific contracting, payment and cancellation conditions set out in a contract or a proposal of their own, which prevail over these terms wherever they differ.

Of the platform

The Imovely brand, the software, the design, the texts and the other elements of the platform belong to Imovely. When you subscribe, you receive a limited, personal, non-exclusive and revocable license of use, solely to use the service in accordance with these terms.

Of the content you upload

The property photos and information you upload remain yours. You declare that you have the necessary rights or authorization over this material and grant Imovely the license to process it to generate the results you request.

Of the AI-generated result

The images, videos, virtual tours and descriptions the platform generates from your material are assigned to you for use, including commercial use, in promoting your properties, subject to the terms of the AI providers operating behind the platform.

Because they are AI-generated, these results may not be protectable by copyright and may be similar to results generated for other users. Always check that the material faithfully represents the property before publishing it.

When using Imovely, you agree not to:

• Use the platform for unlawful purposes or purposes that violate the rights of others;
• Upload content that is not yours or for which you do not have authorization;
• Generate material that misleads the buyer about the property's real characteristics;
• Attempt to copy, decompile or reverse engineer the software;
• Overload, break into or harm the operation and security of the service;
• Resell or redistribute access to the platform without our authorization.

Imovely lets you connect your Instagram professional account to publish the content you create on the platform. The connection is optional and depends on your express authorisation.

By publishing through Imovely, you declare that:

• You hold the rights to the photos, videos and property information you publish;
• You are responsible for the published content and its captions, including price information and property features;
• You will comply with the terms of use and the community guidelines of Instagram and Meta.

Publishing depends on Meta's services. Failures, downtime, publishing limits or content removal by Instagram are outside our control and do not give rise to a refund.

Imovely is not affiliated with, sponsored by or endorsed by Meta Platforms, Inc.

Imovely works to keep the platform available and running well, but the service is provided as is. We do not guarantee that it will always be free of interruptions or errors.

To the extent permitted by law, Imovely is not liable for the use you make of the generated material, for the accuracy of the property information you publish, or for indirect damages arising from the use of the platform. Nothing in these terms removes liabilities that the law does not allow to be excluded.

You can cancel your subscription at any time on the platform itself. Cancellation stops the next charges and keeps your access until the end of the period already paid for. There is no penalty or lock-in.

We may terminate or suspend your access in case of a violation of these terms. After the account is closed, the handling of your data follows our Privacy Policy.

These terms are governed by Brazilian law. For matters related to the service, the jurisdiction of the consumer's domicile is elected, in accordance with the Brazilian Consumer Protection Code (CDC).

If you use Imovely in the European Union, you keep the rights guaranteed by the consumer protection laws of your country of residence.

Before taking any measure, reach out to us through our contact channels: most issues are resolved quickly through direct dialogue. In Brazil, you can also use the consumidor.gov.br platform. In the European Union, the European Commission's online dispute resolution platform.

We may update these terms to reflect changes in the service or in the law. When a change is significant, we let you know through our channels. By continuing to use Imovely after the update, you agree to the new version.

If any clause is deemed invalid, the others remain in force. Tolerating the breach of any condition does not mean waiving it. Matters about personal data follow our Privacy Policy.
